I wanted to know whether Associate Member who is a managing committee member from last year due to latest amendments from October 2018 should continue or resign as per latest amendments Associate Members are even restricted from contesting election
ReplyDeleteI will correct yourself ..the ordinance of oct 2018 amending provision in act is lapsed and hence old existing provisions will apply as far as elections are concerned .secondly, associate member of he is owner of the property can be Committee member provided the ordinary member gives NOC in form 10A , since you have already elected associate member in elections, I presume the returning officer must have taken care of other provisions and Ur member is eligible and now there is no need to remove him or his resignation since oct 18 ordinance is not valid
DeleteSo as you said Oct 2018 Ordinace has expired, to fill casual vacancy of secretary as he has resigned now , can we appoint a new secretary from existing MC members, or we need to write to registrar

ReplyDeleteHello, Can we fill the casual vacancy before 2.5 years after elecion of commitee. As we have now 2 casual vacancies and our commitee was elected in Sept 2018 only.
