CHS Elections Notification 07.09.2019 extention of Existing MC

Dear Friends,

PFA herewith MH Govt Notification Dtd.07.09.2019 extending the term of CHS Managing committee till 31st Dec.2019, in cases where the term of the existing managing committee is over for the CHS with 250 and below members.

As per recent amendment in MCS Act, 1960 , the elections to the CHS with 250 and below members are to be conducted internally as prescribed by rules and till the new rules are introduced specifying the procedure on how to conduct these elections internally, the MH Govt has issued this notification allowing the existing managing committee to continue upto 31st Dec.2019 where the term of the managing committee is over .

    Our housing society in thane are having elections for new committee on 15/09/2019. after reading the above circular can the election still go ahead as planned. Our committee plans to have the entire proccess in a single day(candidate, scrutiny, election, counting,results etc.) They were unwilling to share actual process as per bylaws. Pls guide to the actual process of conducting election and time frame needed.

    1. No elections can be held for society with 250 or less members till 31.12.19 as per the notification issues since to conduct the elections you need to have rules and rules are not yet notified so existing MC to continue till 31.12.19

  3. Shilpa Madam, you are doing fantastic job by creating awareness in CHS Members. Your videos are very informative & excellent, please keep up doing good work, really appreciate.
    Q. - I am owinign flat in CHS@Thane in which my name 1st & my spouse name 2nd on share certificate. In 2013 we did Live&license agreement between my Wife-her own brother including police verification for 11 months as we were not knowing about GR of 2001 on non-occupancy charges & "Family" definition explained in GR. we are not charging any rent from my Brother-in-law, also he & family stays few months in out flat & few months with his parents. Recently secretary ordered to obtain police verification along with Live&License certificate as well charged in monthly bill since Oct. 2018 as non occupancy charges. I wrote MC & secretory almost 8 letters attached with GR of 2001, but still managing committee is not ready to agree & sent me notice with the paper cutting of Lokmat that they will do police complaint & will send me behind bars.
    Please enlighten on "Family" "Non Occupancy Charges" "Live & License" & police verification need to be done for blood relation? what exactly bye laws says? Thanks

    1. If no rent is taken then why the leave and licence agreement is made is the basic question? Brother means blood relationship or ?? Police verification has to be done for leave and license and you need to intimate the society 15 days in advance before letting out the flat ..NOC to be charged from tenant ..if he us a family member then no need but since you have made leave and licence agreement possibly society must be raising NOC charges

  4. If a housing society had already carried out elections for new committee after 9 march 2019 and before 7 Sept 2019 with having 164 flats. How does this circular get applied in that case. Is new committee valid? Please guide us.

    1. The elections conducted internally it seems widout having rules in place so as it is they are not valid .Once the rules are introduced you will have to get the elections reconducted through the returning officer on the panel as is getting Intriduced in new election rules.

  5. Good day madam.
    I am staying in 28 flat society at vasai.
    Our managing committee(only chairman, secretary and NO treasurer in committee)cunducted and election of new committee last year. The management committee kept sitting over it and did not perform the handing over under some or the other excuse.
    This year again this management committee called for an AGM on 26/07/19 for election of new management committee members. Eleven members were elected including the two management committee members by themselfs.The reserve quota seats were not left vacant.
    How ever, till to date handing over has not taken place under the excuse that audit report is not ready. AND WHEN APPROACHED FOR ENQUIRY, IT IS TOLD THAT WE WILL NOT HAND OVER, YOU CAN APPROACH WHO EVER YOU WANT TO.
    Kindly advise what can be done under such circumstances.

    I want to know that, In case of Housing society is registered but Conveyance deed is not done..In this case who should bear the Non Agriculture tax ?? Developer or Housing society ??
